1. Agreement
These terms are an agreement between you and DIYWiser Pty Ltd (ABN [EDIT-ME]) of Toowoomba, Queensland, Australia. They cover the FindItWiser app, the finditwiser.com website, and the physical tag products we sell. By creating an account, using the app, or ordering products, you accept these terms. If you don't agree with them, please don't use FindItWiser.
Nothing in these terms excludes, restricts or modifies any consumer guarantee or right you have under the Australian Consumer Law or other laws that cannot be excluded.
2. Your account
- You must provide accurate information and keep your login details secure. You're responsible for activity on your account.
- You must be at least 13 years old to create an account.
- You can permanently delete your account and all its data at any time inside the app (Profile → Account → Delete account).
3. Your content
Everything you add to FindItWiser — items, photos, receipts, documents, notes — remains yours. You give us a limited licence to store, back up, display and process that content solely to provide the service to you, including sending a photo to our AI provider when you choose to use AI Identify. This licence ends when you delete the content or your account.
You're responsible for what you upload. Don't store content that's unlawful or that you don't have the right to hold.
4. Acceptable use
- Don't attempt to access other users' data, probe or overload our systems, or reverse engineer the service.
- Don't use offensive display names; the leaderboard is visible to other users.
- Don't resell, clone, or misrepresent FindItWiser tags, or register tags fraudulently.
We may suspend or close accounts that breach these terms, with notice where reasonable.
5. Free service and FindItWiser Plus
The core FindItWiser app is free, including a monthly allowance of AI Identify scans. FindItWiser Plus is an optional subscription that unlocks unlimited AI Identify and other premium features as they're released.
- Price: AUD $5.99 per month or AUD $49.99 per year (prices may vary by region and include applicable taxes).
- Billing: Plus is purchased through your Apple ID and auto-renews until cancelled.
- Cancelling: Cancel any time in your device's subscription settings at least 24 hours before the renewal date; you keep Plus until the end of the paid period.
- Refunds for subscriptions are handled by Apple through their standard process.
We may adjust the free tier's allowances or Plus pricing for future periods; we'll give notice of price changes before they affect you.
6. Physical products: tag packs
FindItWiser NFC tag packs and QR sticker packs are one-time purchases sold through finditwiser.com. Each tag is pre-linked and tested before dispatch. Prices are shown in AUD at checkout and include GST where applicable.
- Shipping: Orders are dispatched from Toowoomba, Australia within [2] business days and delivered by Australia Post. Delivery estimates are shown at checkout. International shipping availability is shown at checkout.
- Risk and ownership pass to you on delivery.
- App required: Tags require the free FindItWiser app and an account to function. No subscription is required to use tags.
7. Returns and refunds (physical products)
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. If a tag is faulty or doesn't do what we said it would, you're entitled to a replacement or refund, and we'll cover reasonable return costs. Just email us with your order details and a description of the problem.
Change of mind: Unused packs in their original condition can be returned within 30 days of delivery for a refund of the purchase price; return postage for change-of-mind returns is at your cost.
8. The service
We work hard to keep FindItWiser available and your data safe, but no online service can promise 100% uptime. We may update, add, or remove features over time; if we ever discontinue the service, we'll give you reasonable notice and the ability to export your data. AI Identify produces automated suggestions that may occasionally be inaccurate; always review them before saving.
9. Intellectual property
The FindItWiser app, website, brand, mascot, artwork and tag designs belong to DIYWiser Pty Ltd. These terms don't grant you any right to use our branding except as needed to use the service normally.
10. Liability
To the extent permitted by law, and excluding the consumer guarantees described above, our total liability in connection with the service or products is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect or consequential loss. Nothing in this section limits rights that cannot be limited under Australian law.
11. General
These terms are governed by the laws of Queensland, Australia, and disputes are subject to the courts of Queensland. If part of these terms is found invalid, the rest still applies. We may update these terms; for significant changes we'll notify you in the app, and continued use means acceptance.
